Travel Scholarship 2023

Important: Please read these rules before entering this Scholarship Competition (the “Competition”).

1. The Promoter is WNG Services Pty Limited (ABN: 79 128 500 998) on its own behalf and on behalf of its Related Body Corporates (World Nomads) of Governor Macquarie Tower, Level 18, 1 Farrer Place, Sydney, NSW, 2000, Australia.
2. By applying for this Scholarship (Entrant), you agree to be bound by these Conditions of Entry. All decisions of the Scholarship promoter (World Nomads), are final in all matters relating to the Scholarship. Any changes to these conditions of entry will be published on the World Nomads website at www.worldnomads.com.

Application Period

3. Applications are open from 12:00:01am Eastern Daylight Time (EDT) 13 July 2023 to 11:59:59pm EDT on 20 August 2023 (Application Period). All applications must be received during the Application Period. Applications are deemed to be received at the time of receipt by World Nomads and World Nomads records are conclusive as to the time of receipt. All dates are subject to change if necessary, at World Nomads' discretion.
4. If the Competition cannot be conducted as intended for any reason beyond World Nomads’ control, World Nomads reserves the right to cancel, terminate, modify or suspend the Competition or, if necessary, to provide alternative prizes to the same value as the original Prizes. World Nomads reserves the right or subject to any written directions from a regulatory authority, to modify, suspend, terminate, withdraw or cancel the Competition at any time without notice.

Eligibility Criteria

5. This Competition is open to residents of any country or jurisdiction, who are at least 18 years of age or the age of majority in the relevant jurisdiction (whichever is older) by the end of the application period, except where the Competition is prohibited by law in the jurisdiction in which the entrant is a resident or where the Competition is subject to registration requirements by World Nomads (including without limitation, Italy, Colombia, Brazil, Quebec, Crimea, Iran, Syria, North Korea, and Sudan).

Entrants must

1. Not be professional Photographers or Filmmakers (derive more than 25% of your income from either Photography or Filmmaking);
2. Be available to travel to and be in Norway, arriving by the 19 October 2023 and departing by 30 October 2023. Please note that dates are subject to change and are to be confirmed with winners before accepting the prize;
3. Have a valid passport with at least 6 months’ validity at time of this travel;
4. Be able to secure a visa to travel to Norway, and arrange this themselves at their own cost, prior to travel;
5. Not be employees of World Nomads, Hurtigruten, the Travel Shooters, FUJIFILM Australia Pty Ltd, Think Tank Photo, Adventure.Travel, Tomorrow’s Air and any of their respective parent companies, affiliate companies, subsidiaries, agents, professional advisors, and advertising and promotional agencies, and immediate family members of each and those living in their households. World Nomads reserves the right to request proof of eligibility.

6. To submit a valid application (one entry permitted per person), you must, during the Application Period:
   • Visit the World Nomads Scholarship page at https://www.worldnomads.com/create/scholarships/2023
   • Complete an application form, which includes your Personal Information (contact details).
   • Share one link in the application form that direct to up-to 5 photos or 30 seconds of video that you have created. The photography or video must:
   • visually capture a story about a place you’ve visited.
   • not have been used to win prizes in any other promotions;
   • be posted for public access/ or via a public account. Any content that is unable to be publicly viewed will be automatically disqualified; and
   • be visual (image or video only). Any voiceover or captions must be in English to be understood by judges.
   • Video must take 30 seconds to review in full, or if longer, only the first 30 seconds will be reviewed.
   • Detail in 150 words or less the story and process behind your photography or video submission.
7. Should your submission reach the final round of judging you will be contacted by World Nomads via email to provide additional information in order to confirm your eligibility for the Scholarship. Shortlisted applicants may also be asked to answer additional questions or to attend a short interview online via Zoom as part of the final stages of judging. You must respond to the email within the stated time-frame (approximately 1 week) to remain in the running for the Scholarship.
8. Entrants warrant and agree that:
1. they will not submit any Content that is unlawful or fraudulent, or that World Nomads may deem in breach of any intellectual property, privacy, publicity, or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin, or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
2. their Content shall not contain viruses or cause injury or harm to any person or entity;
3. they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
4. the Content is the original literary work of the entrant that does not infringe the rights of any third party;
5. they consent to any use of the Content which may otherwise infringe their creator's/creators' moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights or otherwise obtained any such consents in relation to third parties' creations (if any) in the Content.
9. Without limiting any other terms herein, the Entrant agrees to indemnify World Nomads for any breach of clause 8.
10. By entering, Entrants grant a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable licence to World Nomads and World Nomads Partners to use, reproduce, modify, adapt, publish, or display their entry (including in publicly-displayed advertising and in a publicly-distributed winner list) to the Scholarship without any compensation, attribution, or liability.
11. One (1) application per person during the Application Period. The odds of winning will depend on the number and quality of entries received during the Application Period. Any attempts to obtain additional entries, including through multiple or duplicate accounts will result in disqualification.

The Prize

12. Following the end of the Application Period, a panel of judges will judge the valid applications and determine the best entries and award three (3) Scholarships.
13. This is a game of skill. Chance plays no part in determining the winner. Each entry will be individually judged, based upon individual creative merit. The three (3) Scholarships will be awarded based on submitted photography/video (70%) and the corresponding written submission (30%). Photography/video will be judged on its creativity, how visually engaging it is and execution equally. Written submissions will be judged based on how well your story brings the photography/video to life and your process behind your work.
14. Selection of the winners of the three (3) Scholarships will be conducted at World Nomads office located at Level 18, 1 Farrer Place, Sydney, NSW, 2000, Australia between 17 July and 6 September, 2023.
15. Scholarship recipients’ names will be published on the World Nomads’ website at https://www.worldnomads.com/create/scholarships/2023 on or before 6 September 2023.
16. If (having made reasonable efforts) we cannot contact a Scholarship winner, or if any prize is not accepted or claimed by 4 September 2023 that scholarship winner’s entry will be deemed invalid, and we reserve the right to distribute unclaimed scholarships to the next best entry.
17. Each of the three (3) Scholarship recipients will receive:
    • Return economy airfare from the recipients nearest international airport to Norway, courtesy of World Nomads (valued at approx. $2,000 USD)
    • A Hurtigruten Norwegian Coastal Express ‘The North Cape Express – Half Voyage from Bergen to Tromsø’ in a Polar Outside cabin, departing on 19 October 2023. Includes main meals (Breakfast, Lunch, Dinner at the main restaurant) and selected beverages during meal times. See full itinerary here. Valued at $8,193 USD (T&C’s relating to this specific prize are set out in clause 24 below).
    • A 9-day mentorship with mentors Dan and Zora (the Travel Shooters) in Norway (valued at approx. $2,000 USD)
    • Fujifilm X-T5 Camera and FUJINON XF18-55mmF2.8-4 R LM OIS lens, valued at $2,399 USD.
    • Think Tank FirstLight® 35L+ Camera Bag, EDC Tech Pouch kit (all 3 sizes) and Secure Pixel Pocket Rocket memory card wallet, valued at $495.75 USD
    • Tomorrow's Air 500kg Carbon Removal Package to help offset winner travel emissions, valued at $500 USD.
    • $500 USD to use towards the trip thanks to Adventure.Travel
    • $150 USD toward the purchase of a travel insurance policy covering the duration of the assignment trip. The winner is required to purchase the policy via a reputable travel insurance provider and provide World Nomads with proof of purchase, at which World Nomads will reimburse the winner up to the value of $150 USD. The winner should ensure the policy suits their individual objectives, needs and financial situation.
    • Total prize valued at RRP $16,237.75 USD
18. The value of the prizes is accurate at the date of commencement of the Competition. World Nomads accepts no responsibility for any variation in the value of the prizes after that date. The prize cannot be refunded, transferred, substituted or redeemed for cash. World Nomads reserves the right in its sole discretion to substitute the prizes with cash or a prize of comparable value if the prizes cannot be awarded as described for any reason.
19. The winners will be responsible for all personal expenses and any other expenses, fees and costs connected with the prize that are not included in the prize description.
20. The winners are responsible for ensuring that they have valid passports, and any required visas, vaccinations and travel documentation for travel to Norway. World Nomads reserves the right to substitute a prize of comparable or greater value for any prize. The prize, or any unused portion of the prize, is not exchangeable or transferrable, cannot be extended and cannot be taken as cash if the prize is not fulfilled.
21. All prizes are awarded “As is” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). All federal, state and local taxes associated with the receipt or use of any Prize are the sole responsibility of the winner. If the winner is a resident of the United States, the winner a will be required to provide a social security number and will be issued a Form 1099.
22. World Nomads will not replace any lost or stolen cash or prize items once they are in the winner’s possession. Any unclaimed and/or unused prize (or portion of a prize package) will remain the property of World Nomads.
23. World Nomads, and other providers of any prize, and Facebook Inc. and any other Social Media Platform (as defined below) on which the Competition is promoted, and each of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, agents, professional advisors, contractors, and advertising/marketing and contest agencies (collectively, “Released Parties") shall have no liability for any personal injuries, death property damage, or other damages or expenses resulting from or arising out of any travel related to the prize or any other aspect of prize winner’s or traveling companion’s acceptance of the prize.
24. By accepting the prize, the winners accept the following terms apply to the Hurtigruten Norwegian Costal Express portion of the prize:

1. The Prize is a 9 day, 7 night voyage on the North Cape Express Half Voyage for three individual winners departing Bergen on 19 October 2023.
2. Prize includes accommodation in an unspecified Polar Outside Cabin; all meals (Breakfast, Lunch, Dinner at the main restaurant) and selected beverages during meal times. The Prize is valued from $8,193 USD per person as of 28 June 2023. The ‘from’ price may be subject to fluctuation as Hurtigruten Norwegian Coastal Express has a flexible pricing system and all prices are capacity controlled and subject to availability.
3. Inclusions are as outlined in the itinerary.
4. Exclusions, anything not listed in the above.
5. Cabins are subject to availability and block out dates may apply depending on availability. If your chosen date does not have an unspecified Polar Outside Cabin available, you can look at the option to pay the difference to a higher cabin class or choose a new date of departure.
6. The prize excludes transfers to and from domestic or international airports, unless specified.
7. No payments will be made for any costs associated with claiming the prize.
8. All references to time in this document are a reference to the local time in Sydney, New South Wales, Australia on the date stated.
9. No compensation will be payable if a winner is unable to use the prize as stated.
10. The Prize must be taken as offered, is subject to availability and is non-refundable, non-transferrable and not redeemable for cash or any other goods or services. The Prize cannot be resold. The Prize cannot be transferred to any other person, unless agreed to by World Nomads and Hurtigruten. It is a condition of accepting a prize that the winner accept the conditions of use of the Prize.
11. The Prize excludes purchases on board the ship (e.g. including but not limited to beverages, spa, shopping), meals off the ship, optional tours, travel insurance, tips and gratuities, spending money, transport from Winner’s home to and from departure airport or port, visas, passports and vaccinations.
12. If any prize (or part of any prize) is unavailable, World Nomads, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
13. The trip may be supplemented with upgrades and additional arrangements outside of the itinerary, at the winner’s own expense.
14. If any act, omission, event or circumstance occurs which is beyond the reasonable control of World Nomads and Hurtigruten and which prevents World Nomads from complying with these terms and conditions, World Nomads will not be liable for any failure to perform or delay in performing its obligations. World Nomads reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.
15. Hurtigruten Norway accepts no responsibility for any tax implications that may arise from accepting a prize. Independent financial advice should be sought.
16. Receipt of a prize may have Fringe Benefits Tax (FBT) implications. To the extent that there is any FBT liability, this will be paid for by the employer of the recipient. The grossed-up value of a prize and any other Fringe Benefits the recipient receives during the course of the FBT year may be reported on the recipient’s annual PAYG Payment Summary as required by taxation law.

18. The Northern Lights Promise does not apply to prize winner itineraries.

Privacy and Marketing Statement

25. The Promoter will handle your Personal Information in accordance with its Privacy Policy. You may request access or to update your Personal Information or lodge a complaint by emailing the Privacy Officer at privacy@worldnomads.com. 26. World Nomads collects entrants’ Personal Information for the purpose of conducting and promoting this Scholarship (including but not limited to determining and notifying the winners). By entering into the Competition, Entrants consent to World Nomads disclosing their Personal Information to the various partners, and World Nomads’ related entities to process and deliver the Scholarship, and to improve World Nomads’ products and services.
27. By entering the Competion, Entrants acknowledge that a further primary purpose for collection of the Personal Information is to contact the Entrant in the future with information about World Nomads, including special offers, market research or to provide marketing materials via mail, commercial electronic messages (SMS (Short Message Service) and email or any other form of non-real time electronic, emerging, digital or conventional communications channel whether existing now or in the future.
28. World Nomads may share an Entrant's Personal Information with its Australian and overseas related companies, promotional partners, employees, agents and trusted third parties who may contact the Entrant for their legitimate commercial purposes. By entering the Competition, Entrants acknowledge and agree that World Nomads and any applicable third parties may use their Personal Information in the manner set out in this condition.
29. The Entrants will participate in all reasonable promotional activities in relation to the Scholarship, as requested by World Nomads and their agents. This may include the winners’ names, likeness, images and/or voices (including photograph, film and/or recording of the same), in any media worldwide for whatever purpose and without notification, remuneration or compensation, for marketing and or promotional purposes, for an indefinite period.
30. Personal information including Entrant’s name, email, intent to travel, country of residence and email will be collected and used for the purpose of conducting this Competition and associated marketing activities. This may require disclosure to third parties including Hurtigruten Norway, the Travel Shooters, FUJIFILM Australia Pty Ltd, Think Tank Photo, Travel, Tomorrow’s Air and World Nomads’ agents or third party service providers, for the purpose of conducting the Competition and associated marketing activities.
31. Please refer to World Nomads’ Privacy Policy for more information about how we use your Personal Information at http://www.worldnomads.com/privacy, Privacy Policy UK and IE at https://www.worldnomads.com/privacy/notice-for-uk-and-ireland and Privacy Policy EEA: https://www.worldnomads.com/privacy/notice-for-EEA . We will not share your contact information with partners without your consent (as indicated by the checked boxes on the website).
32. If you have marked the “opt-in” box on the entry form relating to a third party collecting your Personal Information, you consent to World Nomads sharing your Personal Information with Hurtigruten Norway, the Travel Shooters, FUJIFILM Australia Pty Ltd, Think Tank Photo,and the storage of your Personal Information on their database/s. Hurtigruten Norway, the Travel Shooters, FUJIFILM Australia Pty Ltd, Think Tank Photo, Travel, Tomorrow’s Air may use this information for their future promotional and marketing purposes regarding their products and services including contacting you via electronic messaging provided that where required by the Spam Act 2003 (Cth). Hurtigruten Norway, the Travel Shooters, FUJIFILM Australia Pty Ltd, Think Tank Photo, Adventure.Travel, Tomorrow’s Air communications will include a functional unsubscribe facility in each direct marketing communication it sends you that you may use to opt-out of any further such communications and provided that the functional unsubscribe facility complies with the Spam Regulations 2021 (Cth). You should contact Hurtigruten Norway, the Travel Shooters, FUJIFILM Australia Pty Ltd, Think Tank Photo,  Adventure.Travel, Tomorrow’s Air or any relevant third party/ies for their privacy policy/ies.

Limitations of Liability/Releases

33. Subject to Applicable Law, by entering the Scholarship, the winner agrees that their acceptance is conditional upon their compliance with all relevant laws, rules and regulations. You release World Nomads and all Released Parties, including Hurtigruten Norway, the Travel Shooters, FUJIFILM Australia Pty Ltd, Think Tank Photo, Travel, Tomorrow’s Air from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Scholarship or delivery, misdelivery, acceptance, possession, use of, or inability to use, any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory except for any liability which cannot be excluded by law.
34. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties or similar consumer protection laws in the State and Territories of Australia, or any other similar laws applicable in the country of the Entrant.
    

Name and likeness rights

35. By entering the Competition and submitting your Submission to World Nomads in connection with the Competition, you hereby grant to World Nomads a perpetual, irrevocable, royalty-free, worldwide, nonexclusive license to publish, reproduce, display, perform, distribute, adapt, edit, modify, translate, create derivative works based upon, and otherwise use and sublicense your Submission, or any portion thereof, in connection with the Competition and for other advertising, marketing and promotional purposes, and to incorporate Submissions, in whole or in part, into other works in any manner, form, media or technology now known or later developed. World Nomads will have no obligation to publish or use or retain any Submission you submit or to return any such Submission to you. You agree that it is your sole responsibility to obtain all permissions and releases necessary for the grant of the rights contained in this paragraph and these Terms and Conditions. You agree to take, at World Nomads expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by World Nomads to effect, perfect or confirm World Nomads’ rights as set forth above and in these Official Rules.

License to submissions

36. By entering the Competition and submitting your Submission to World Nomads in connection with the Competition, you hereby grant to World Nomads a perpetual, irrevocable, royalty-free, worldwide, nonexclusive license to publish, reproduce, display, perform, distribute, adapt, edit, modify, translate, create derivative works based upon, and otherwise use and sublicense your Submission, or any portion thereof, in connection with the Competition and for other advertising, marketing and promotional purposes, and to incorporate Submissions, in whole or in part, into other works in any manner, form, media or technology now known or later developed. World Nomads will have no obligation to publish or use or retain any Submission you submit or to return any such Submission to you. You agree that it is your sole responsibility to obtain all permissions and releases necessary for the grant of the rights contained in this paragraph and these Terms and Conditions. You agree to take, at World Nomads expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by World Nomads to effect, perfect or confirm World Nomads’ rights as set forth above and in these Official Rules.

No Facebook or Other Social Media Platform Endorsement

37. This Competition is in no way sponsored, endorsed or administered by, or associated with Facebook, Inc. or any other social media platform (each, a “Social Media Platform”). You understand and acknowledge that by using and interacting with any Social Media Platform, you are subject to the terms, conditions, and policies that govern the use of such Social Media Platform. You should therefore review the applicable terms and policies for each Social Media Platform (such as facebook.com, www.twitter.com, www.instagram.com, www.tiktok.com) including privacy and data gathering practices, before using or interacting with a Social Media Platform.

General Terms and Conditions

38. The Competition and these Terms and Conditions will be governed, construed and interpreted under the laws of New South Wales, Australia. This Competition is subject to all applicable federal and state laws and is void where prohibited or where applicable law requires World Nomads to register this Competition.
39. If any provision of these Terms and Conditions are deemed unenforceable they will be enforced to the extent permissible, and the remainder of these Terms and Conditions will remain in effect.
40. The Promotor reserves the right to amend these Terms and Conditions or to terminate this Competition at any time. Entrants who violate these Terms and Conditions, violate any law, rule or regulation in connection with participation in the Competition, tamper with the operation of the Competition or engage in any conduct that is detrimental or unfair to World Nomads, the Competition or any other entrant (in each case as determined in World Nomads’ sole discretion) are subject to disqualification from entry into the Competition.
